Terms and Conditions
Please note, these are the terms and conditions of the supplier of this experience
day. Experience Mad terms and conditions also apply.
Definitions
"Experience" means the experience purchased by You against which the
Voucher can be redeemed as detailed in the Information Page;
"Information Page" means the web page on the Site informing You of
the precise details of a specific Experience prior to purchase;
"Recipient" means the individual who undertakes the Experience whether
you or someone you purchase a Voucher on behalf of;
"Supplier" means the third party Supplier of the Experience;
"Voucher" means the Voucher purchased by You through the Site;
"You" or "Your" means the person or persons who purchase
the Voucher through the Site;
Vouchers - validity and redemption.
When You purchase an Experience You will be sent a Voucher (unless stated)
which can be redeemed against Your chosen day. When the Recipient wishes to
redeem the Voucher please call the booking line provided on the voucher to make
the necessary arrangements. Please note that All Experiences are subject to
seasonal availability and booking limits. The Experience for which a Voucher
has been purchased must be undertaken by the Recipient prior to the expiry date
stated on the Voucher.
Expiry dates will be clearly marked on the Voucher. If You
cannot find or are unsure of the date please contact the booking centre. A voucher
will be deemed to be invalid if it is out of date (the validity date is clearly
stated on the gift voucher).
Vouchers can be exchanged for another Experience, only once, providing the Voucher
is still valid and You or the Recipient pays any additional cost. If the exchange
is for a lower value Experience then the difference will be held in a credit
account for a maximum of 10 months from the date the original Voucher was purchased.
If the amount is not redeemed against an Experience during this period then
all monies will be forfeited.
We will not replace lost Vouchers.
Vouchers cannot be exchanged for cash.
Only original Vouchers will be accepted - no photocopies.
Please note once your experience has been booked with a supplier, the date cannot
be changed for any reason
By undertaking the Experience, the Recipient agrees to be bound by these terms
and conditions.
Restrictions
The Experience may have height, age, weight and health restrictions.
We have outlined these on the Information Pages. They are there to make the
Experiences safe for all participants. We reserve the right to refuse participation
if customers have failed to inform us of any conditions that would make participation
in the Experience dangerous for themselves or any other party.
With certain Experiences the Recipient may be required to sign a disclaimer,
produce a medical certificate or complete a medical questionnaire by completing
such documents You warrant that the person/ people undertaking the Experience
are sufficiently mentally and/or physically fit enough to safely undertake such
Experience. The booking centre will be happy to advise the Recipient if they
require further clarification.
Weather
The Recipient should contact the Supplier prior to departure to check
the likelihood of cancellation due to weather. Telephone numbers will be provided
with Your pack.
Refund and Cancellation
Vouchers holders will not be reimbursed for travelling and other related
expenses caused by cancellation due to adverse weather. You may cancel a purchase
of a Voucher within 7 days of purchase and we shall refund the monies paid for
the Voucher to You. All refunds will incur a £20 or 20% (whichever is
greater) administration charge.
How to cancel
Write to us within 7 working days of delivery of Your Voucher, quoting
Your Voucher number. You must not use the Voucher and take reasonable care of
it. Vouchers may be returned to our Suppliers or us. The appropriate return
address will be provided in the voucher pack.
Venues
Where possible we will aim to accommodate Your Experience at Your chosen
venue. However at certain times, certain venues or vehicles maybe withdrawn
or cancelled by the Supplier of the Experience. Where this occurs we will offer
You or the Recipient an alternative venue or exchange Your Experience for one
of a similar value.
Suppliers
We are a booking agent only and are not responsible for the management
or delivery of any of the Experiences; these are managed through our Suppliers.
We do not accept responsibility or liability for any loss, injury or negligence
caused by the Supplier.
Insurance
Some of our Experiences have an element of risk attached to them. In
some instances You will be required to sign a disclaimer before participating.
Please be advised that we are not responsible for any claims arising from death,
personal injury which does not arise as a result of cancellation whilst participating
in an Experience. We would advise all Recipients to take out insurance against
these before participating.
Description and Images
Where possible we have used images of the actual Experience on the Site.
However, because of the varied locations used this may not be actual picture
of Your Experience but a similar one. We have made reasonable endeavours to
check accuracy of descriptions and images provided by our Suppliers.
Complaints
As we are committed to on going quality and service improvement, we welcome
Your comments and feedback on Your Experience. If in the unlikely event of You
experiencing a problem, please initially take this up with the Supplier on the
day, so that if possible they can attempt to rectify the problem immediately.
Severability of Clauses
Each clause and sub-clause to these Terms should be construed independently
from every other clause in these Terms to the effect that the validity or invalidity
of one clause or sub-clause shall not effect the validity of the remainder of
the Terms.
Law and Jurisdiction
These Terms are governed by and will be interpreted in accordance with
English Law and any disputes relating to these Terms will be exclusively subject
to the jurisdiction of the English courts.
